GENERAL TERMS AND CONDITIONS/TOUR PACKAGE

1) PRACTICE OPENING FEE

An enrollment fee is charged on each apartment rental file, the amount of the fee is variable depending on the type

of the structure. The amount of the practice opening fee is indicated on each apartment sheet published on our website (payment of the deposit implies acceptance/subscription of this contract)

2) PAYMENTS

At the same time as the reservation, the Client is required to pay the selling agency a deposit equal to 25% of the total amount of the stay, in addition to additional costs (ferry, Opening Practice fee, insurance, if any).
The balance by bank transfer must be paid 15 days before the start of the trip/stay.
For reservations made less than 15 days before the start of the trip/stay, the Client is required to pay the full amount in full. In the event that the Client wishes to pay the balance upon arrival, the balance may be paid in cash or by check. In the event of non-payment to the Seller Agency for the services booked within the above terms, the Seller Agency shall have the right to decide, at its sole discretion, to invalidate any previously issued travel documents/tickets and cancel the services booked and/or proceed legally to obtain payment for the same.
In case of joining the non-refundable rate, the Client will make the balance of the full amount at the time of booking confirmation.

3) RESERVATIONS

Easyelba will send the customer traveler “Option Quote” containing: detailed description of all services offered, the price of these services, the amount of the deposit and a copy of the “General Terms and Conditions.”

La prenotazione si intenderà perfezionata al momento della conferma scritta, da parte di Easyelba al cliente viaggiatore, dell’avvenuta ricezione della caparra. Payment of the above deposit automatically implies confirmation of receipt, reading and acceptance of these ” General Terms and Conditions” by the Traveling Customer.

4) VARIATIONS OF THE ORGANIZER

Information, descriptions, promotions, offers, seasonality and rates reported on this site are to be considered accurate, subject to errors, omissions and updates. Easyelba reserves the right to communicate any changes at any time. Should force majeure make it necessary, Easyelba reserves the right to substitute the accommodation and/or resort. The traveler must notify Easyelba in writing of his or her choice to cancel or take advantage of the alternative package no later than 2 days after receipt of the alternative proposal. Failure by the Customer to accept any changes, will only and exclusively commit Easyelba to return the collected amounts within 7 working days from the time of the communication from the Customer

5) CUSTOMER CHANGES

For each and every variation requested by the Client traveler, subsequent to the reservation will be charged at a flat rate of Euro 30.00 per practice plus any penalties.

6) ASSIGNMENT

A traveler who is unable to take advantage of the booked trip may surrender his or her reservation to a person who meets all the conditions required for the trip. The transferor must notify Easyelba by registered mail with return receipt, which must be received no later than 4 working days before the start of the stay, indicating the particulars of the transferee. The transferring traveler and the transferee are jointly and severally liable for the payment of the price as well as for the additional expenses arising from said transfer and quantified in Euro 30.00.

7) CANCELLATION WITHDRAWAL

In case of withdrawal from the travel contract, the conditions according to the fare selected at the time of booking will be applied.

Penalties for cancellation Standard Rate:

  • 25% of the amount of the stay up to 31 days after arrival
  • 50% of the amount of the stay from 31 to 15 days after arrival
  • 75% of the amount of the stay from 15 to 10 days after arrival
  • 100% of the amount from 9 days after arrival.

+ cost of insurance if taken out

Penalties for cancellation Relaxation Rate:

  • For cancellation up to 28 days after the beginning of the stay:

Full refund of the deposit paid and any ferry fees,

non-refundable practice opening fee.

  • For cancellation from 27 to 15 days before arrival: 50% of the amount of the stay
  • For cancellation 15 to 10 days before arrival: 75% of the amount of the stay
  • For cancellation from 9 days after arrival: 100% of the amount of the stay

+ ferry ticket (any penalties from the shipping company)

8) CONDITIONS FOR APARTMENT RESERVATIONS

The property is leased as transient and secondary housing during the summer vacation period. The parties agree that this contract is concluded expressly for that purpose, to the exclusion of any other. The contract will be in the name of individuals only and not vat subjects unless previously agreed upon.

PRICES

Prices quoted, unless otherwise indicated, are per apartment and for the period indicated. They include: the rental of the premises with related services, furniture, dishes and kitchen items and accessories essential for a short vacation stay, V.A.T. Water, electricity, gas consumption are also included.

Fees do NOT include linen services, final cleaning, the cost of any extra beds, and practice opening fee, any tourist tax and anything else not specifically mentioned as included or free of charge.

DELIVERIES

Except where otherwise indicated, apartments will be delivered from 4:30 p.m. to 7:00 p.m. on the day of arrival and must be returned by 9:30 a.m. on the day of departure in excellent clean condition with special reference to the kitchen and bathrooms. If, due to force majeure, arrival is delayed, the agency must be notified.

Under no circumstances shall the accommodation be allowed to be occupied by more adults and children than the number for which the apartment is arranged.

DEPOSIT 

On arrival a deposit for any damages must be paid to the agency except where otherwise indicated, which will be returned at the end of the stay after inspection of the apartment and subject to deduction for reimbursement of damages caused or for failure to clean the kitchenette or to properly dispose of waste during the period of stay. The amount of the security deposit is indicated in each accommodation card.

ANIMALS

Animals are allowed, if accepted in the relevant facility, only with express permission.

CONDITIONS FOR HOTEL RESERVATIONS PRICES

The prices in the tables shown on the website, are per person in a double room with services on the basis of the treatment indicated, with the relevant supplements and reductions (for extra beds the years are understood to be not completed) and inclusive of VAT and service percentage. The treatment chosen should be the same for all occupants of the room. Extra meals purchased individually may have a higher price, any meals not taken will not be refunded. Not included in the prices are beverages, tips, extras in general, any tourist tax and anything else not specifically mentioned as included or free of charge.

HOTEL DELIVERIES.

Except where otherwise indicated, rooms will be delivered from 3 p.m. to 7 p.m. on the day of arrival and must be returned by 9 a.m. on the day of departure. If, due to force majeure, arrival is delayed, it is necessary to notify the management of the accommodation facility.

CLASSIFICATION OF HOTEL/RESIDENCE ACCOMMODATIONS

Classifications and categories of hotel accommodations are assigned according to current regulations by the relevant local authorities. For non-hotel accommodations, or in the absence of an official classification, Margherita Viaggi assigns its own subjective rating based on the quality standards present

9) COMPLAINTS
In the event of any complaints concerning the services received, in order that there may be evidence of the inconvenience complained of and that it may be promptly remedied, the Traveling Customer shall make immediate contact with Easyelba. The Customer may also submit a written complaint by registered mail to be sent to Easyelba no later than 10 working days after the end of the services specified in the Travel Contract.

10) RESPONSIBILITY
The sale of tourist packages/services dealt with on this site is governed by these General Conditions and the provisions of the International Convention on Travel Contracts (C.C.V.) ratified and made enforceable by Law no. 27/12/1977. 1084 – as applicable – as well as by the Consumer Code set forth in Legislative Decree no. 206 of 06/09/2005 (Articles 82-100) and its subsequent amendments. Pursuant to Articles 85-86 of L.D. no. 206 of 06/09/2005, the Seller Agency that makes the booking of tourist services on behalf of the Traveling Customer, is obliged to sign with the Traveling Customer the Travel Contract that describes in detail all the services booked and that specifies unequivocally that the Traveling Customer has read, accepted and received a copy of the General Conditions listed on the Margherita Viaggi website Failure to complete or incomplete completion and signing of the Travel Contract will relieve Margherita Viaggi from any liability for failure to comply with the obligations placed on the Seller Agency and the Consumer. No liability shall accrue to Margherita Viaggi for damages and/or inconveniences caused by: strikes, suspensions or delays due to adverse weather conditions, natural disasters, public works, traffic accidents, water shortages, electricity shortages, communication and transportation disruptions. These cases, or similar ones, cannot be blamed on the organizer, nor on the carriers, nor on the service providers. Any additional costs incurred by the Client as a result of these causes will not be reimbursed, nor will any services that, due to these causes, are lost or not recoverable. In addition, the organizer cannot be held liable for any damages that result from autonomous initiatives taken by the traveler during the execution of the trip. Baggage travels at the Client’s risk and Margherita Viaggi will not be liable for any theft, loss or damage.

11) OBLIGATION OF ASSISTANCE
The organizer is obliged to provide the measures of assistance to the traveler imposed by the criterion of professional diligence, exclusively with reference to the obligations incumbent on him.

12) LIABILITY INSURANCE
To cover the risks arising to persons from participation in travel or stay programs as well as to guarantee the exact fulfillment of the obligations assumed towards clients, Margherita Viaggi has taken out with the insurance company Mondial assistance, a “Flat Premium” Civil Liability policy for Travel Organizers and Intermediaries. Policy number 190610, pursuant to Art. no.86 L.R.T. no.42 of 23/03/2000 and no. 14 of 17/01/2005.

13) GUARANTEE FUND
In accordance with Art. 100 D.L. no. 206/2005 is provided for the establishment of a guarantee fund at the Ministry of Productive Activities from which all travelers can benefit in case of insolvency or bankruptcy of the seller or organizer. The modalities of the fund’s intervention are established by decree of the Ministry of Productive Activities (Art. 100 Decree Law 206/2005).

14) COURT OF JURISDICTION
For any disputes and controversies, the court of the Livorno district shall have exclusive jurisdiction.

15) CONSENT TO THE PROCESSING OF PERSONAL DATA
All personal data will be processed in full compliance with the provisions of Legislative Decree 196/2003 and used exclusively for the fulfillment of the formalities inherent in the realization of reservations and for the shipment of our advertising material.
Customers have the right to change, supplement, and request cancellation of the personal data provided.

The Client is required, at the same time as the reservation, to pay
